UṢŪL AL-FIQH

Al-Waraqāt of
Imam al-Juwayni

Al-Waraqat is a foundational text in Usul al-Fiqh (principles of Islamic jurisprudence), written by Imam al-Juwaynī (d. 478 AH / 1085 CE), one of the great scholars of the Shafi’i school and a key figure in Islamic legal theory.

The book introduces students to the basic concepts and terminology of usul al-fiqh, including:

– Sources of Islamic law (Qur’an, Sunnah, Ijmā‘, Qiyās)
– Types of legal rulings (ḥukm: wājib, mandūb, ḥarām, etc.)
– Conditions of ijtihād
– Qualities of a mujtahid
– Categories of speech and commands in Islamic law

Despite its brevity, Al-Waraqat has been widely studied for centuries and serves as a beginner’s manual in legal theory. Many scholars have written commentaries on it to clarify and expand on its concise content. It remains an essential text in traditional Islamic legal education.

Consists of 12 classes.
