QAWĀʿID FIQHIYYA

Al-Irtishāf fī Īḍāḥ Qawāʿid al-Khilāf of Shaykh Ibrāhīm ibn Shuʿayb

Al-Irtishāf fī Īḍāḥ Qawāʿid al-Khilāf is a specialized treatise in qawāʿid fiqhiyya (legal maxims) authored by the Mālikī jurist Shaykh Ibrāhīm ibn Shuʿayb. The work is dedicated to elucidating the underlying maxims and principles that govern khilāf—juridical disagreement—within Islamic law. Rather than focusing merely on differences in rulings, the author seeks to expose the deeper methodological rules and interpretive frameworks that give rise to legitimate scholarly divergence.

In this text, Ibn Shuʿayb outlines and analyzes a set of legal maxims that explain why jurists differ, such as variations in understanding linguistic constructions, principles of textual interpretation, evidentiary weighting, and procedural reasoning within and across schools of thought. His approach is both analytical and didactic, offering clarity to students and scholars navigating the complexities of legal pluralism in Islamic jurisprudence.

Firmly rooted in the Mālikī tradition yet addressing broader Sunni legal theory, Al-Irtishāf contributes to the genre of qawāʿid al-khilāfiyya, a subfield concerned with the causes and categories of legal disagreement. It remains a valuable resource for advanced students of fiqh and uṣūl al-fiqh, especially those seeking to deepen their understanding of the jurisprudential logic behind differences of opinion in Islamic law.
